Justice Abrew seeks SC order staying arrest

Justice Sarath de Abrew yesterday withdrew his fundamental rights petition and sought an interim order from the Supreme Court to restrain the police fro Late-City-DM-1-20m arresting him and an order staying further proceedings against him at the Mt. Lavinia Magistrate’s Court.

President’s Counsel Manohara de Silva appearing for the petitioner Sarath de Abrew, informed Court his client has been released on bail by the Magistrate’s Court and as such there is no reason for his imminent arrest and requested permission to withdraw the FR petition. The SC Bench comprising Chief Justice K. Sripavan, Justices Priyantha Jayawardane adnd Anil Gooneratne allowed the motion and dismissed the petition. The petitioner cited the following as respondents: Mt. Lavinia Headquarters Inspector Chanaka Iddamalgoda, CID Chief Inspector Wanasinghe, CID Director B.R.S.R. Nagahamulla, the IGP, Colombo South General Hospital Director Asela Gunawardena and the Attorney General.

Additional Solicitor General Yasantha Kothagoda appeared with Senior State Counsel Mathawa Tennakoon while Dr Avanti Perera appeared for the Police Officers and the Attorney General. J.C. Weliamuna appeared for the aggrieved domestic helper Mathotage Nilusha Damayanthi. Shibly Aziz PC appeared with M.A.Sumanthiran and Suren Fernando for the President of the Bar Association Jeffry Alagaratnam PC.
