FR filed against prorogation

A fundamental rights petition was filed in Court by public interest litigation lawyer Nagananda Kodithuwakku seeking an order against the gazette notice proroguing Parliament. 

 

The petition states that the fundamental rights of all Sri Lankans have been violated by the gazette notice which has disregarded the concept of the rule of law and parliamentary traditions.   


The petitioner has instituted the action under section 12 (1), which states that, “All persons are equal before the law and are entitled to the equal protection of the law” under the Constitution of Sri Lanka.   


The petition seeks Court to issue notice against the respondents cited in the petition (Attorney General, the Speaker and Prime Minister Ranil Wickremasinghe) as well as an order to cancel the Gazette notice issued on October 27, 2018.   

 

The petitioner has instituted the action under section 12 (1) under which all persons are equal under the law
